DWI Charge Levels in Otter Tail County

Minnesota breaks DWI offenses into four degrees. Each level carries different penalties, and all create court records in the Otter Tail County system.

Fourth-degree DWI is a misdemeanor under Statute 169A.27. This applies when no aggravating factors are present. It carries up to 90 days in jail and a $1,000 fine. Most first-time offenders in Otter Tail County get probation and treatment as part of their sentence. Third-degree DWI under Statute 169A.26 is a gross misdemeanor. It kicks in when one aggravating factor is present, such as a blood alcohol level at or above 0.16, or a prior DWI within ten years.

Second-degree DWI is also a gross misdemeanor, but it involves two or more aggravating factors. First-degree DWI is the most serious. It is a felony that can result in up to seven years in prison and $14,000 in fines. Anyone with three or more prior incidents in ten years, or a previous felony DWI, faces this charge. These felony cases generate extensive records at the Otter Tail County District Court.

Note: Aggravating factors include a child under 16 in the vehicle, a prior DWI, a BAC of 0.16 or higher, or a prior license revocation for test refusal.

DUI License Revocation in Otter Tail County

When someone gets arrested for DWI in Otter Tail County, two things happen at once. The criminal case goes to the District Court. The license revocation is handled separately by the Minnesota Department of Public Safety.

Under Statute 169A.52, failing a breath test triggers an automatic license revocation. A first-time test failure leads to a 90-day revocation. Refusing the test brings a one-year revocation. The arresting officer gives the driver a temporary 14-day license, and the revocation starts after that. Drivers can challenge the revocation through an administrative hearing or file a petition for judicial review within 60 days.

The ignition interlock program under Statute 171.306 lets eligible drivers get a restricted license while their regular license is revoked. The device checks for alcohol before the car will start. Participation lasts at least two years for most offenders. Repeat offenders face longer periods. The Driver and Vehicle Services division manages enrollment and monitoring for the program.
