Polk County sits along the North Dakota border. Crookston, East Grand Forks, and several smaller towns make up the county. Cross-border traffic between Minnesota and North Dakota means the court sees DUI cases from both local residents and out-of-state drivers passing through. Under Statute 169A.20, driving with a blood alcohol level of 0.08 or higher is a crime in Minnesota. The law also bans driving under the influence of controlled substances and cannabis products.
East Grand Forks sits right across the Red River from Grand Forks, North Dakota. The two cities share a metro area, and DWI enforcement is active on both sides. But only arrests that happen on the Minnesota side get filed in Polk County.

Fourth-degree DWI is a misdemeanor under Statute 169A.27. No aggravating factors are present. Penalties include up to 90 days in jail and $1,000 in fines. Third-degree DWI is a gross misdemeanor. It applies when one aggravating factor exists, such as a BAC at 0.16 or above, a prior DWI in the past ten years, or a child in the car.
Second-degree DWI involves two or more aggravating factors and is also a gross misdemeanor. First-degree DWI under Statute 169A.24 is a felony. License Revocation After a Polk County DUI
A DUI arrest in Polk County triggers both a criminal case and an administrative license action. The criminal side goes through the District Court. The license part is handled by the Department of Public Safety.
Under Statute 169A.52, a first-time breath test failure leads to a 90-day license revocation. A test refusal brings a one-year revocation. The officer hands the driver a 14-day temporary license at the time of arrest. Drivers can challenge the revocation through an administrative review or a court petition filed within 60 days.
The ignition interlock device program under Statute 171.306 allows some drivers to get a restricted license during revocation. The device checks for alcohol before the car starts. The DVS division runs the program. Participation lasts at least two years for most offenders, and repeat offenders face much longer requirements.
