Koochiching County DWI Offense Degrees
Minnesota law creates four levels of DWI charges. The degree depends on how many prior incidents the driver has and what aggravating factors are present. Koochiching County prosecutors use the same system as every other county in the state.
A fourth-degree DWI is a misdemeanor. No aggravating factors present. A first-time offender with a BAC under 0.16 usually gets this charge. The penalties include possible jail time, fines up to $1,000, and a license revocation. Many Koochiching County DUI cases start here.
A third-degree charge under Statute 169A.26 is a gross misdemeanor. One aggravating factor puts the case at this level. A BAC at 0.16 or above, a prior DWI within ten years, or a child in the vehicle all count as aggravating factors. Second-degree DWI requires two or more such factors. Both gross misdemeanor levels can bring up to a year in jail and $3,000 in fines.
First-degree DWI under Statute 169A.24 is a felony. It applies when the person has three or more qualified prior incidents in the past ten years or already has a felony DWI on their record. Maximum penalty is seven years in prison and a $14,000 fine. These are the most serious DUI records you will find in Koochiching County.
License Consequences for Koochiching County DUI
Getting arrested for DUI in Koochiching County starts an automatic license revocation through the state. This is separate from the court case. The arresting officer sends a report to the Department of Public Safety, and the revocation process begins.
Under Statute 169A.52, failing a breath test on a first offense means 90 days without a license. Refusing the test gets you a one-year revocation. A BAC of 0.16 or higher also triggers a one-year revocation. The officer gives you a temporary license for 14 days, and then the revocation starts.
Koochiching County drivers can apply for the ignition interlock program to get limited driving privileges during the revocation. The device checks your breath before the car will start. If the BAC reads 0.02 or above, the car stays off. Participation periods range from two to ten years. After all requirements are met, reinstatement follows the process outlined in Statute 171.178.
Note: Check a driver's license status online at drive.mn.gov to see if a revocation is in effect due to a DWI in Koochiching County.
